1. Acceptance of Terms
By accessing or using HungryNow (“Platform”), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Platform. These Terms apply to all users — customers, restaurant owners, and delivery riders.
2. Platform Role
HungryNow is a technology marketplace that connects customers with restaurants and riders. We are not a restaurant, food manufacturer, or delivery company. We do not take custody of food or handle payments. All food preparation is by restaurants; all payments are directly between users via UPI.
3. Account Registration
- You must be at least 18 years old to create an account.
- Provide accurate, current, and complete information during registration.
- You are responsible for maintaining the security of your password.
- Notify us immediately of any unauthorised use of your account at support@hungrynow.in.
- One account per person or business entity. Multiple accounts for the same entity may be suspended.
4. Customer Terms
- Orders placed on HungryNow constitute a binding offer to the restaurant.
- Payment must be completed via UPI within 15 minutes of order confirmation.
- Upload a clear payment screenshot as proof. False payment claims are grounds for immediate account suspension and legal action.
- Food quality and preparation are solely the responsibility of the restaurant. HungryNow makes no warranty regarding food quality, hygiene, or ingredients.
- Delivery timeframes are estimates. HungryNow is not liable for delays caused by traffic, weather, or other circumstances beyond our control.
5. Restaurant Owner Terms
- Restaurants must hold a valid FSSAI licence throughout their listing period.
- Menu items, prices, and availability must be kept accurate and current.
- Restaurants are responsible for food safety, hygiene standards, and accurate allergen information.
- Subscription fees are non-refundable unless the platform fails to onboard the restaurant within the agreed timeframe.
- Restaurants must confirm or reject orders within 10 minutes. Repeated unresponsiveness may result in listing suspension.
- Restaurants agree not to solicit customers to transact outside the platform for orders initiated on HungryNow.
6. Rider Terms
- Riders must hold valid driving licences and vehicle registration documents.
- Riders are independent contractors, not employees of HungryNow.
- Riders must maintain their vehicle in roadworthy condition and carry appropriate insurance.
- Riders are responsible for safe and timely delivery of orders.
- Tampering with, consuming, or damaging orders will result in permanent account ban and may attract legal action.
7. Prohibited Conduct
Users must not:
- Provide false information during registration or order placement
- Submit fraudulent payment screenshots
- Harass, abuse, or threaten other users or HungryNow staff
- Use automated tools to scrape data or place bulk orders
- Attempt to reverse-engineer or interfere with platform systems
- List or order illegal, prohibited, or controlled substances
8. Dispute Resolution
Disputes between users (e.g., non-delivery, payment conflicts) should first be attempted to be resolved directly. If unresolved within 24 hours, either party may raise a formal dispute through the order page. HungryNow will mediate and issue a binding decision within 3 business days. Our decision regarding platform-level disputes is final.
Legal disputes shall be governed by the laws of India, with exclusive jurisdiction in courts of Bengaluru, Karnataka.
9. Limitation of Liability
To the maximum extent permitted by law, HungryNow shall not be liable for any indirect, incidental, special, or consequential damages arising from use of the platform, including food quality issues, delivery delays, payment failures between users, or platform downtime. Our total aggregate liability to any user in any calendar month shall not exceed the subscription or service fees paid by that user in that month.
10. Termination
HungryNow reserves the right to suspend or terminate any account for breach of these Terms, fraudulent activity, or any conduct harmful to other users or the platform, without prior notice. Users may delete their accounts at any time from the profile settings page.
11. Changes to Terms
We may revise these Terms from time to time. Material changes will be communicated via email and in-app notification at least 14 days in advance. Continued use of the platform after the effective date constitutes acceptance of the revised Terms.
